ACCURACY RESEARCH. HEALTH CONSULTING AND CONTRACT RESEARCH ORGANIZATION. HEALTH RESEARCH. CIA. LTDA. recognizes the importance of privacy and protection of the personal data of the owners and is committed to complying with the required standards of protection of personal data. Therefore, it has adopted confidentiality and security measures necessary for the information that is provided and/or to which it has access, in compliance with the provisions of the Organic Law on Protection of Personal Data (Ecuador).

The content of this document is strictly informative.

OBJECTIVE:

The purpose of this policy is to inform the conditions under which the personal data of the Company’s customers and/or users are protected and treated.

SCOPE:

– This policy applies to all communication channels, processes and activities carried out by ACCURACY RESEARCH manually or electronically and that include or are related to personal data.
– For the purposes of the Organic Law on Personal Data Protection, this policy applies to all processing of personal data carried out by ACCURACY RESEARCH.

GLOSSARY OF TERMS

– Personal data: Data that identifies or makes identifiable a natural person, directly or indirectly.
– Data subject: Natural person whose data is the object of processing.
– Responsible for the processing of personal data: Natural or legal person, public or private authority or other body that alone or jointly with others decides on the purpose and processing of personal data.
– Processor: A natural or legal person, public or private, public authority or other body that alone or jointly with others processes personal data on behalf of and for the account of a controller of personal data.
– Processing of personal data: Any operation or set of operations performed on personal data, whether by technical procedures of an automated, partially automated or non-automated nature, such as: the collection, compilation, obtaining, recording, organization, structuring, conservation, custody, adaptation, modification, deletion, indexing, extraction, consultation, elaboration, use, possession, exploitation, distribution, assignment, communication or transfer, or any other form of enabling access, matching, interconnection, limitation, suppression, destruction and, in general, any use of personal data.

PURPOSES OF PROCESSING:

– Fulfillment of the conditions necessary for the effective provision of the contracted product or service.
– Processing of requirements and/or claims.
– Registration, support and control of operations derived from customer service.
– Compliance with legal and regulatory obligations.
– Analyze and discover customer needs.
– Perform analysis and improvement of products and services.
– Conduct market research.
– Perform customer satisfaction analysis and statistical research.
– Develop commercial actions for products and services.
– Marketing and promoting different products and services (including sending advertising by any means).
– Fulfillment of contractual obligations.

TIME OF CONSERVATION:

Personal Data will be kept for no longer than the time necessary to fulfill the purpose of its processing.
To ensure that Personal Data is not retained longer than necessary, the Data Controller will conduct a review of its Database every five years.
Personal Data may be retained for processing for a longer time than previously established for statistical research purposes, for which security and protection guarantees for Personal Data will be implemented.

LEGAL BASIS FOR PROCESSING:

All processing of personal data is carried out in strict compliance with Articles 7 and 8 of the Organic Law for the Protection of Personal Data based on:
– Consent of the holder for the processing of his personal data, for one or more specific purposes.
– The processing is necessary for the execution of pre-contractual measures at the request of the holder or for the fulfillment of contractual obligations pursued by the controller of personal data, processor of personal data or by a legally authorized third party.

EFFECT OF PROVIDING ERRONEOUS OR INACCURATE PERSONAL DATA

The refusal to provide data or providing inaccurate data may cause the purpose for which they are collected can not be fulfilled in whole or in part.

Therefore, ACCURACY RESEARCH shall not be liable for the results derived from the processing of information as a consequence of erroneous, outdated or inaccurate data. ACCURACY RESEARCH reserves the right not to provide the corresponding services in the event that erroneous, outdated or inaccurate data is provided.

TRANSFERS OR COMMUNICATIONS OF PERSONAL DATA

In order to comply with the purposes previously described, personal data may be consulted, shared, transferred and/or communicated to its suppliers, subsidiaries, affiliated, related and/or auxiliary companies, companies in charge of data processing and/or companies with which the Company maintains a national or international relationship. For this purpose, ACCURACY RESEARCH guarantees that appropriate technical and organizational measures will be implemented to protect personal data.

COMPANY AS RESPONSIBLE FOR THE PROCESSING OF PERSONAL DATA

RIGHTS OF THE OWNERS

The holders of personal data have the right to access and rectify the processing of their personal data.
To exercise their rights, the legal representative or owner of the personal data may access, rectify, update, delete, oppose and/or suspend the use of their personal data at any time, in accordance with the Law and applicable regulations.

Please take into consideration that it will be necessary to prove your identity as the owner or legal representative of the owner in order to carry out the procedure. ACCURACY RESEARCH undertakes to respond to such request within a reasonable period of time in accordance with the applicable law and regulations.

PROCEDURE TO REVOKE CONSENT

The holder or his legal representative may request the revocation of his consent to the processing of personal data at any time and free of charge.

The data protection officer of ACCURACY RESEARCH will contact you to inform you of the result of your request or, if necessary, request additional information to validate your identity or clarify the processing of your request.

SECURITY MEASURES

In order to protect the personal data under its responsibility, ACCURACY RESEARCH has implemented a personal data protection management system aligned with the PERSONAL DATA PROTECTION LAW.

DATA PROCESSOR

When ACCURACY RESEARCH makes arrangements to commission the processing of personal data, it is guaranteed that this will be carried out in strict compliance with the Personal Data Protection Law.

NOTIFICATIONS AND POLICY CHANGES

ACCURACY RESEARCH will notify through the available channels the updating of this policy and its changes prior to its entry into force.
